emTRUTH Terms and Conditions

Please read these terms and conditions carefully before using Our Service.

Interpretation and Definitions

Interpretation The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions For the purposes of these Terms and Conditions:

  • Application means the software program or web-based application, named emTRUTH patient provided by the Company.

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to EMTRUTH, INC., 1209 Orange St, Wilmington, DE 19801.

  • Patient Data means any health records, personal identifiers, or information uploaded by You to the Service.

  • Personal Blockchain means the decentralized ledger architecture used by the Service where Patient Data is encrypted and stored, for which the private keys are held exclusively by You.

  • Service refers to the Application or the Website or both.

  • You means the individual accessing or using the Service.

Patient Data Ownership and Absolute Control

1. Lifelong Ownership and Sovereignty You maintain exclusive, lifelong ownership and control of all Patient Data stored via the Service. Your data is stored on a Personal Blockchain. The Company acts only as the provider of the interface and tools to manage this data; we do not own, claim rights to, or control Your data.

2. Access and Sharing You have the sole authority to grant access to Your Patient Data. You may voluntarily share Your data with:

  • Healthcare professionals or providers.

  • Individuals to whom You have granted legal Power of Attorney.

  • Any other third party at Your express discretion.

3. Inaccessibility by the Company The Service is designed such that the Company does not have access to Your Patient Data. All data is encrypted locally, and the Company does not store or possess Your private keys or decryption passwords.

4. Legal Requests and Subpoenas Because the Company does not have access to Your Patient Data and does not possess the technical means to decrypt it, the Company cannot and will not provide Your Patient Data to any third party, including government agencies, law enforcement, or litigants, even if presented with a subpoena or court order. The Company cannot be forced to share what it does not possess and cannot access.

5. Perpetuity and Company Sale Your ownership and control of Your Patient Data are permanent. In the event that emTRUTH, Inc. is sold, merged, or acquired by another entity, these Terms regarding Your absolute ownership and the Company’s lack of access shall remain in full force. Any successor entity shall be legally bound by this same commitment to Your data sovereignty.

Acknowledgment

These Terms and Conditions set out the rights and obligations of all users. By accessing the Service, You agree to be bound by these Terms. You represent that you are over the age of 18.

Collection and Privacy of Phone Numbers

We collect your phone number only when you voluntarily provide it for account verification via SMS One-Time Password (OTP).

  • Privacy: We will not sell or transfer your phone number to any third party.

  • Opt-out: You can opt out at any time by texting STOP.

Termination

You may cease using the Service at any time. Because You own Your data on Your Personal Blockchain, Your access to Your data is independent of Your relationship with the Company, provided You maintain Your private keys.

Limitation of Liability

To the maximum extent permitted by law, the Company's liability is limited to the amount actually paid by You through the Service or 100 USD. As the Company does not have access to Your data, the Company is not responsible for any loss of data resulting from Your loss of private keys or passwords.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided "AS IS." While we provide the safest architecture for data control, the Company does not warrant that the Service will be uninterrupted or error-free.

Governing Law

The laws of Delaware, United States, shall govern these Terms.
